By accessing and using GoPrivate's website building and hosting services, you accept and agree to be bound by the terms and provision of this agreement. These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "you", or "your") and GoPrivate ("we", "us", or "our").

If you do not agree to abide by the above, please do not use this service. We reserve the right to modify these terms at any time, and such modifications shall be effective immediately upon posting.

2. Our Services

GoPrivate provides professional website design, development, hosting, and maintenance services specifically tailored for healthcare professionals, therapists, tutors, consultants, and other service-based professionals.

Our services include but are not limited to:

  • Custom website design and development
  • Domain registration and management
  • Web hosting and technical support
  • Content management system setup
  • SEO optimsation
  • Ongoing maintenance and updates

We strive to deliver high-quality services but do not guarantee specific results or outcomes from your website's performance.

3. User Accounts and Responsibilities

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password and for all activities that occur under your account.

You agree to:

  • Provide accurate and truthful information about your professional credentials
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorised use of your account
  • Use our services in compliance with all applicable laws and regulations
  • Respect the professional standards of your industry

4. Payment Terms

Payment for our services is due according to the billing schedule outlined in your service agreement. We accept major credit cards and bank transfers for payment processing.

Key payment terms:

  • Setup fees are due upon service activation
  • Monthly/annual hosting fees are billed in advance
  • Late payments may result in service suspension after 7 days
  • Refunds are available within 14 days of initial payment for new customers (excluding one-time setup fees)
  • No refunds for partial months of service

We reserve the right to change our pricing with 30 days' notice to existing customers.

5. Content Guidelines

You are responsible for all content you provide for your website, including text, images, videos, and other materials. All content must comply with applicable laws and professional standards.

Prohibited content includes, but is not limited to:

  • Illegal, harmful, or offensive material
  • Copyrighted material without proper authorisation
  • False or misleading professional claims
  • Content that violates patient confidentiality
  • Spam or unsolicited promotional material

We reserve the right to remove any content that violates these guidelines without prior notice.

6. Intellectual Property Rights

The website design, code, and GoPrivate branding elements remain our intellectual property. However, you retain ownership of all content you provide, including text, images, and professional credentials.

Upon full payment, you receive a non-exclusive license to use the website design for your professional business. This license terminates if you stop using our services.

You grant us permission to use your website as a reference example in our marketing materials, unless you specifically opt out of this arrangement.

7. Service Termination

Either party may terminate this agreement with 30 days' written notice.

We may terminate services immediately for:

  • Non-payment of fees after 7 days past due
  • Violation of these terms of service
  • Use of services for illegal activities
  • Breach of professional conduct standards

8. Limitation of Liability

Our services are provided "as is" without warranties of any kind. We strive for 99.9% uptime but cannot guarantee uninterrupted service availability.

Our liability is limited to the amount you have paid for services in the 12 months preceding any claim. We are not liable for:

  • Lost profits or business opportunities
  • Data loss (though we maintain regular backups)
  • Third-party actions or service interruptions
  • Consequential or indirect damages

9. Governing Law

These Terms shall be interpreted and governed by the laws of England and Wales. Any disputes arising from this agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.

We encourage resolving any disputes through direct communication before pursuing legal action.
